When can you evict a tenant?

As a landlord, you must have good reason to evict a tenant. Nonpayment of rent is the most common reason for eviction. If the tenant breached the lease or used, delivered or produced a controlled substance on the leased property, you have every right to give the tenant a three-day notice to cure the breach or leave the premises. If the tenant fails to pay the rent owed, fix the breach in the lease or leave the property during those three days, you can start an eviction action against him or her. You may also evict a tenant who has overstayed the lease and has not moved after you gave 30-days notice to leave.

However, if the tenant has paid rent and has not done anything legally wrong, eviction is not an option. Furthermore, you must comply with all of your duties as a landlord. If you have not kept the premises in a habitable condition and the tenant has withheld rent, you will probably not be able to evict him or her.

The eviction process in Idaho

Before you can start an eviction action against your renter, you must give him or her written notice of the eviction (three-days or 30-days, depending on the situation). If the tenant does not leave the premises during that time, you can file an unlawful detainer action to regain your property.

In cases where the tenant failed to pay rent or committed an unlawful drug activity on the premises, your case will move through expedited proceedings, which allows you to regain possession of the property within two weeks. All other cases go through the regular eviction process, which takes longer than the expedited process and requires serving a summons and complaint on the tenant and allowing time for the tenant to file an answer.
